Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Unsigned, the website, app and services operated by Unsigned Now LLC (“Unsigned”, “we”, “us”, “our”), a Wyoming limited liability company at 1021 E Lincolnway, Suite #10234, Cheyenne, Wyoming 82001, USA.
Introduction and Acceptance
By creating an account, or by accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. These Terms incorporate our Privacy Notice, Cookie Notice and Billing Terms, each available on our website.
Definitions
“Service” means the Unsigned platform, website and app. “User”, “you” means the person or entity using the Service. “User Content” means any material you upload. “Recipient” means a label, DJ, curator or other music-industry contact surfaced through the Service.
Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you confirm that you meet these requirements and that the information you provide is accurate and kept up to date.
Your Account
You are responsible for your account and for keeping your login details secure. You are responsible for all activity that happens under your account. Tell us promptly at info@unsigned.now if you believe your account has been accessed without your permission.
The Service and Licence to Use
Unsigned helps independent artists identify relevant music-industry contacts and prepare submission pitches. We grant you a limited, non-exclusive, non-transferable and revocable licence to use the Service for your own music submissions, subject to these Terms. We may update, change or withdraw features at any time.
Acceptable Use
You agree not to: use the Service for any unlawful purpose; send spam or bulk unsolicited messages; scrape, copy or extract the contact database except as the Service allows; attempt to bypass sending limits, credits or security; upload content you do not have the rights to; impersonate any person; or interfere with or disrupt the Service. We may suspend or terminate accounts that breach this section.
Contact Database and Outreach
7.1 Source of Contact Information
Contact information is sourced from publicly available sources, including the recipients’ own official websites, social media and link-in-bio pages, public submission pages, and publicly indexed search results. Unsigned takes reasonable steps not to scrape or reproduce any third-party platform’s private member directory, and to collect only professional, business-role contact details and not to store private, non-professional contact data.
7.2 Permitted Use
Contact information may only be used for legitimate music submission and context-sharing outreach. Users agree to use it solely to submit original music for consideration.
7.3 User Responsibility
Unsigned generates draft outreach content. The user is solely responsible for reviewing, editing and sending all communications from their own account.
7.4 Compliance With Applicable Law
Users are responsible for the content of, and their decision to send, each communication, and for ensuring their own use of the Service complies with applicable laws including the UK GDPR and EU GDPR, PECR and the ePrivacy Directive (for UK/EU recipients), the CAN-SPAM Act and CASL. Unsigned remains responsible, as controller, for the lawful operation of its contact database and the drafting features it provides. Nothing in these terms transfers Unsigned’s own controller obligations to the user. Communications to recipients are sent by users from their own email accounts; Unsigned does not transmit them and is not the sender. Unsigned does not provide legal advice.
7.5 Lawful Bases for Processing in the EU/EEA and UK
These legal bases are described within the Privacy Notice and the Data Processing Addendum, both of which form part of our terms of service.
7.6 Database Accuracy
Unsigned makes reasonable efforts to verify contact information but does not guarantee accuracy. Contact details change frequently in the music industry.
7.7 No Spam Policy
Unsigned prohibits use of the platform for spam or mass unsolicited outreach. The platform has no bulk-send or automated-send function: a user selects one recipient, reviews the draft on screen, and sends it from their own inbox, so there is structurally no way to mass-contact recipients through the platform. Unsigned maintains a recipient-facing removal route and a suppression list so that any recipient who asks to be removed is not re-added or shown to users again. Accounts that abuse the platform are suspended immediately without refund.
7.8 Third-Party Platforms
Where a recipient accepts submissions via a third-party platform, Unsigned may surface that recipient’s public submission link. Unsigned is independent of, and not affiliated with or endorsed by, any such platform, and submissions made through it are subject to that platform’s own terms.
7.9 Attribution and Recipient Rights Notice
When a user sends outreach through the Service, the user is an independent controller of that outreach and, because the user obtained the recipient’s details indirectly (via Unsigned), the user owes the recipient their own transparency information. To give effect to this, the first message a user sends to any given recipient must include, and Unsigned will include in the draft it generates for that first message, a short notice that: (a) identifies the user as the sender; (b) explains that the recipient’s professional contact details were identified via Unsigned; and (c) tells the recipient how to find out more about how their data is held and how to exercise their data-protection rights (including to opt out or be removed). Users must not remove or alter this notice, and must not send the message from an anonymous, masked or misleading address that prevents the recipient identifying the sender. This notice must appear on each user’s first message to each recipient — that is, once per user, per recipient. A user need not repeat it in their own later messages to the same recipient, but the obligation applies afresh to every user: a recipient is entitled to the notice from each separate user who contacts them, because each user is a distinct controller. The notice enables recipients to exercise their rights both against the sending user and, as to the database, directly with Unsigned, which acts as controller of the contact database.
The notice included in that first message will read substantially as follows (sent as part of the user’s own message; Unsigned may refine the wording):
“I found your professional contact details via Unsigned (unsigned.now), which maintains a database of music-industry submission and booking contacts. If you’d like to know how your details are held, or to exercise your data-protection rights — including to opt out or ask for your details to be removed so you are no longer listed or contacted through Unsigned — please see unsigned.now/privacy or email info@unsigned.now.”
The link (unsigned.now/privacy) points to Unsigned’s recipient-facing privacy page, which Unsigned will publish and maintain. Unsigned will action any opt-out or removal request received in response and suppress the contact so it is not shared with users or re-added.
User Content and Music Uploads
You retain all ownership of and rights in any music, audio, artwork or other material you upload (“User Content”). You represent and warrant that you own or control all necessary rights in your User Content and that it does not infringe the rights of any third party. You grant Unsigned a limited, non-exclusive, royalty-free licence to store, process, analyse and create derived data from your User Content for the sole purpose of providing the service to you, including audio analysis and generating pitch and metadata content. This licence ends when you delete the User Content or close your account. On deletion of your User Content or closure of your account, Unsigned deletes or anonymises data derived from your User Content (such as audio analysis and generated content) within a reasonable period, save where retention is required by law. Unsigned does not claim ownership of your music and will not distribute or publish your User Content beyond what is needed to provide the service.
AI-Generated Content
Unsigned uses artificial intelligence to analyse audio and generate pitch emails, metadata and related content (“AI Output”). AI Output is provided as a draft to assist you and may contain errors, inaccuracies or unsuitable content. You are solely responsible for reviewing, editing and approving all AI Output before sending or using it. Unsigned does not warrant that AI Output is accurate, complete or fit for any particular purpose. Unsigned does not permit its AI service providers to use your User Content or personal data to train their models.
Intellectual Property and Protection of the Database
The Service, and all software, text, design and branding within it, are owned by Unsigned or its licensors. Except for the limited licence to use the Service, no rights are granted to you.
The contact database and all listings, data, compilations and materials made available through Unsigned are the property of Unsigned or its licensors and are provided for your own use within the service only. You may not scrape, crawl, copy, export, aggregate, resell, redistribute or reproduce any part of the database or its contents, or create any derivative database or derivative content from its content, by automated means or otherwise, except as expressly permitted by these terms. Contact details are provided to enable your own legitimate submissions and may not be used for bulk marketing or shared with third parties.
Subscriptions, Trials and Billing
Our paid plans, free trial, billing, automatic renewal, cancellation, price changes and refunds are governed by our separate Billing Terms, which form part of these Terms and are available at unsigned.now/billing. Where these Terms and the Billing Terms conflict on any billing or refund matter, the Billing Terms apply. In summary: we offer a 7-day free trial that requires no payment method and involves no charge; when the trial ends your account moves to the Free plan automatically unless you actively subscribe by adding a payment method; and you are only ever charged after you take that step and give separate, express consent to automatic renewal. Full details — including your cancellation and refund rights and additional protections for consumers in the UK, EU and certain US states — are set out in the Billing Terms.
No Guarantee of Results
Unsigned is a tool that helps you identify and contact labels, DJs and curators and prepare submissions. Unsigned does not guarantee any outcome, including any response, listen, placement, release, signing or other result. Recipients are independent third parties who decide for themselves whether and how to respond. Unsigned has no control over, and accepts no responsibility for, the decisions or conduct of any recipient.
Disclaimers and Warranties
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any contact information is accurate or current.
Limitation of Liability
To the fullest extent permitted by law, Unsigned will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or opportunities, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD 100. Nothing in these Terms limits liability that cannot be limited by law.
Indemnification
You agree to indemnify and hold harmless Unsigned and its officers and employees from any claims, losses, liabilities and reasonable expenses arising from your use of the Service, your User Content, your communications with recipients, or your breach of these Terms.
Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or misuse the Service. On termination, the licences you grant us end as described in the User Content section, and any provisions that by their nature should survive will survive.
Changes to the Service and to These Terms
We may change these Terms from time to time. If a change is material, we will give reasonable notice by the means we normally use to contact you. Any change to billing follows the Billing Terms. Continuing to use the Service after a change takes effect means you accept the updated Terms.
Governing Law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules, and without affecting any mandatory consumer-protection rights that apply where you live.
Dispute Resolution
If you have a problem, please contact us first at info@unsigned.now so we can try to resolve it. Any dispute not resolved informally will be subject to the courts of the State of Wyoming, unless mandatory law where you live provides otherwise.
General
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with the Privacy Notice, Cookie Notice and Billing Terms, form the entire agreement between you and Unsigned regarding the Service. You may not assign these Terms; we may assign them to an affiliate or successor. Our failure to enforce any provision is not a waiver of it.
